These Terms and Conditions (“Terms”) apply to:

your use of our website: www.as-pigments.co.uk (the “Site”); and
-
any orders you place for products through the Site (the “Products”).
By using the Site or placing an order, you agree to these Terms. If you do not agree, you must not use the Site or buy any Products.
2. Who can buy from us

You must be at least 18 years old to place an order.

Our Site is mainly for customers in the United Kingdom.

We can also ship to other countries on request. Extra rules, charges and restrictions may apply for international orders.
Many of our Products are intended for professional use (for example, semi-permanent makeup or cosmetic pigments). You are responsible for making sure that:
-
you (or the person using the Products) have the right training and skills;
-
you follow all safety, hygiene and legal requirements that apply in your country;
-
you perform patch tests and obtain any needed consent from your clients.
We do not provide medical advice and our Products are not medical devices.
3. Creating an account
You can browse the Site without creating an account, but you may choose to register for an account.

Keep your login details safe.

You are responsible for anything done using your account.

Tell us straight away if you think your account has been compromised.
4. Ordering and our contract with you
Step 1 – Place your order
You place an order by adding Products to your basket and completing checkout. Please check all details (products, quantities, address, shipping, etc.) before confirming.
Step 2 – Order confirmation
We send you an email confirming that we have received your order. This is not our acceptance yet.
Step 3 – Acceptance
Your order is accepted and a contract is formed when we:
-
send you an email confirming dispatch; or
-
dispatch the Products,
whichever happens first.
We may refuse or cancel an order, for example if:
-
the Product is out of stock;
-
there is a pricing or description error;
-
we cannot get payment authorisation;
-
we believe the order is fraudulent;
-
we cannot ship to your address.
If we cancel after you have paid, we will refund any money you have paid for that order.
5. Products and descriptions
We try to make sure that all descriptions, photos and information on the Site are accurate and up to date. However:

colours may look different on different screens;
-
results may vary from person to person, skin type and technique;
-
packaging and formulations may change slightly over time.
If we make small changes, we will not normally notify you, as long as the quality and performance of the Product is not negatively affected.
6. Prices, taxes and payment

Prices are shown in GBP (£).

Unless we state otherwise, prices include UK VAT where applicable.

Delivery charges and any other fees are shown separately at checkout.
We may change our prices at any time. The price you pay is the one shown at checkout when you place your order.
We accept the payment methods shown on the Site (for example, major credit/debit cards and/or other payment services). By providing payment details, you confirm you are authorised to use that method.
If we discover a clear pricing error, we do not have to supply the Product at the incorrect price. We will contact you and give you the option to:

continue at the correct price; or
-
cancel your order and receive a refund.
7. Delivery
7.1 UK delivery

We deliver to UK addresses using the options shown at checkout.
-
Estimated delivery times are shown during checkout. These are estimates, not guarantees, but we will deliver within any time limits required by law.

Risk in the Products passes to you when they are delivered to the address you gave us.
-
Ownership of the Products passes to you when we receive full payment.
7.2 International delivery (on request)
We may be able to deliver to other countries on request.
If you are outside the UK:
-
delivery may take longer and cost more;
-
you are responsible for all customs duties, taxes and import charges;
-
you must make sure that the Product can be lawfully imported and used in your country;
-
we are not responsible if Products are delayed, held or seized by customs or other authorities.
8. Your right to cancel (consumers)
This section applies if you are buying as a consumer and not as a business.
When you buy Products online, you usually have a 14-day cooling-off period to cancel your order without giving a reason, starting from the day after you (or the person you nominate) receive the Products.
8.1 How to cancel
To cancel, you must clearly tell us (for example by email) that you want to cancel your order:

You can use the Model Cancellation Form in section 17, but you do not have to.
You must send your cancellation request within 14 days from the date you receive the Products.
8.2 When you cannot cancel
You cannot cancel in some cases, for example:
-
sealed Products which are not suitable for return for health or hygiene reasons once opened (this will often include pigments, creams and similar items if the seal is broken or they have been used);
-
Products made to your specific requirements or clearly personalised;
-
Products that have been used, mixed, contaminated or otherwise made unsuitable for resale.
If in doubt, contact us before opening or using the Product.
9. Returning Products after cancellation (consumers)
If you cancel a contract:
-
You must send the Products back to us within 14 days of telling us you want to cancel.
-
You are responsible for the cost of returning them, unless we have agreed otherwise or the Products are faulty or mis-described.
-
You should keep proof of postage.
Please return Products (where possible):
-
in their original packaging; and
-
in a condition suitable for resale (other than reasonable handling to check them).
9.1 Refunds
If you validly cancel:
-
we will refund what you paid for the Products, plus the standard delivery cost (if you paid for a more expensive delivery method, we will not refund the extra);
-
we may reduce your refund if the Products have been handled more than necessary;
-
we will issue the refund within 14 days of:
-
receiving the Products back, or
-
receiving evidence that you have sent them back, whichever is earlier.
-
We will refund you using the same payment method you used, unless we agree otherwise.
10. Faulty or not-as-described Products
If you think a Product is faulty or not as described, please contact us as soon as possible:
-

Provide your order number, details of the problem, and photos if you can.
We may ask you to return the Product for inspection.
If the Product is found to be faulty or not as described, we will:
-
repair or replace the Product where possible; or
-
offer a refund if repair or replacement is not possible or appropriate; and
-
refund reasonable return costs where the Product is faulty.
Nothing in these Terms affects your legal rights as a consumer.
11. Returns process (all customers)
For any return (cancellation or faulty item):
-
Contact us first at sales@as-pigments.co.uk.

Wait for our return instructions.
-
Pack items securely and include your name, order number and contact details.
-
Keep your proof of postage.
12. Using our website
You agree that you will not:
-
use the Site for any unlawful or fraudulent purpose;
-
attempt to gain unauthorised access to any part of the Site, our systems or data;
-
introduce viruses, malware or other harmful code;
-
use robots, scrapers or other automated systems to access the Site without our permission.
We do not guarantee that the Site will always be available or error-free. We may suspend or change the Site at any time.
You are responsible for your own internet connection, devices and security software.
13. Intellectual property
The Site and its content (including text, images, logos, graphics and Product names) are owned by us or our licensors.
You must not:

copy, reproduce or distribute Site content for commercial purposes;

use our trademarks or logos without our permission.
You may print or download reasonable parts of the Site for your personal use or to help you place an order.
14. Reviews and user content
If you submit reviews, comments, photos or other content (“User Content”) to the Site or our social channels:

you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce and display that content in connection with our business;

you confirm that your content is lawful, accurate and does not infringe anyone else’s rights;
-
you must not post anything that is offensive, defamatory, obscene or otherwise inappropriate.
We may remove User Content at any time if we think it breaches these rules or for any other reasonable reason.
15. Our responsibility to consumers
We do not exclude or limit our liability where it would be unlawful to do so, including for:

death or personal injury caused by our negligence;

fraud or fraudulent misrepresentation.
If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our actions or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
We only supply Products for domestic and private use. If you use the Products for any commercial or business purpose, our liability will be limited as set out in section 16.
We are not responsible for:

adverse reactions caused by failure to follow instructions, lack of patch testing, poor hygiene or inadequate training;
-
problems caused by misuse, improper storage or mixing of Products.
16. Additional terms for business customers
This section applies if you are buying in the course of a trade, business or profession.

You confirm that you have authority to bind the business on whose behalf you place the order.

Products are supplied for internal business use or resale only where we have specifically agreed (for example, authorised distributors).
To the extent allowed by law:

we exclude all implied warranties and terms (including as to quality or fitness for a particular purpose);
-
our total liability for any claim in connection with an order is limited to the amount you paid for that order;
-
we are not liable for loss of profit, loss of business, loss of anticipated savings, loss of goodwill, or any indirect or consequential loss.
17. Privacy and data protection
We will handle your personal data in line with applicable data protection laws.

18. Events beyond our control
We are not responsible for any delay or failure to perform our obligations if this is caused by something outside our reasonable control (for example: strikes, transport problems, natural disasters, pandemics, war, government actions, failure of utilities or communication networks).
If such an event occurs:

we will take reasonable steps to reduce the impact; and
-
if there is a risk of significant delay, you may contact us to cancel and receive a refund for any Products you have paid for but not received.
19. Changes to these Terms
We may update these Terms from time to time.

The version that applies to your order is the version in force when you placed the order.

For Site use, the current version will apply each time you use the Site.

We will show the date of the latest version at the top of this page.
20. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales.
If you are a consumer:

you can bring legal proceedings relating to the Products or these Terms in the courts of England and Wales;
-
if you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts;
-
if you live outside the UK, you may have the right to bring proceedings in your local courts and rely on any mandatory consumer protection laws in your country.
If you are a business customer, the courts of England and Wales have exclusive jurisdiction over any dispute relating to these Terms or the Products.
